1. Scope & Provider

These Terms and Conditions govern all contracts for PETDUO 5R™ diagnostic services concluded through the website 5r.petduo.com between the customer and:

("Provider", "we", "us"). The diagnostics are carried out by PETDuo (Anne Louise Gelfei and David Elie Merlino).

The online order process is designed for consumers. If you wish to order as a business, please contact us at 5r@petduo.com before ordering.

2. Services

PETDUO 5R™ is a professional diagnostic service for electronic music producers. Each diagnostic evaluates one track through the five PETDUO 5R™ lenses: Rhythm, Reach, Retention, Release Readiness and Relevance. The service includes, depending on the diagnostic ordered:

• Track Diagnostic (€49) — Complete written PETDUO 5R™ diagnostic of one track: assessment across all five lenses, evidence with timestamps, a prioritised action plan and a release recommendation. Delivered within 3 business days.
• Video Diagnostic (€79) — Everything in the Track Diagnostic, plus a personalised video walkthrough with audible timestamp demonstrations, a Technical Snapshot and a clear action order. The Technical Snapshot is one focused technical inspection of a high-impact aspect of the track; it is not a full mixing or mastering review. Delivered within 5 business days.
• Re-Diagnostic (€25) — Focused diagnostic of a revised version: comparison with the previous diagnostic, resolved and remaining issues, updated priorities and an updated release recommendation. Available only for a revised version of a track previously evaluated through PETDUO 5R™. Delivered within 3 business days.

Each order covers one track. The written diagnostic is the complete diagnostic reference; the video walkthrough complements it. The delivery periods are explained in section 6.

Diagnostics are available in English, Spanish (Español), Portuguese (Português), French (Français) and German (Deutsch). You choose the language in the onboarding form. For German, the written diagnostic is in German and the Video Diagnostic walkthrough has German subtitles.

3. Order Process & Conclusion of the Contract

An order is placed in the following steps:

1. On the PETDUO 5R™ website you select a diagnostic and click its "Book" button.
2. An order confirmation page shows the service, what is included, the scope (one track), the delivery period and the price including VAT. To continue, you confirm that you agree to these Terms and have read the Privacy Policy, and you expressly request that we begin the service before the end of the withdrawal period (see section 11). Both confirmations are required to order.
3. "Continue to payment" takes you to the payment page of our payment provider Stripe, where you enter your email address and payment details and see the total price again.
4. By clicking the final payment button on the Stripe payment page, you submit a binding order. The contract is concluded when your payment has been successfully completed.
5. After payment you are taken to the onboarding form for your diagnostic (section 4). We then send you a contract confirmation by email from 5r@petduo.com. It sets out your order and your request for early performance and includes, as PDF attachments, these Terms and our Withdrawal & Cancellation Policy with the model withdrawal form. We send it within a reasonable time after the contract is concluded and in any event before we begin work. You also receive a receipt for your payment (section 5).

Correcting input errors. Until you click the final payment button you can review and correct all entries. You can return from the order confirmation page to the diagnostics overview with "Back to diagnostics" or your browser's back button, and you can change or correct your entries on the Stripe payment page. If you close the page before paying, no order is placed and nothing is charged.

Contract language. The contract is concluded in English.

Storage of the contract text. We store the details of your order (service, price, time of order and your confirmations, including the exact wording you confirmed). There is no customer account in which you can access them. The version of these Terms in force at the time of your order is sent to you with the contract confirmation; the current version is always available on this page.

Codes of conduct. We have not subscribed to any code of conduct.

Weekly capacity. Each diagnostic has its own limited weekly availability. While you are on the payment page, a place is held for you for a limited time (approximately 30 minutes). If payment is not completed in that time, the place is released. When a diagnostic is fully booked, it cannot be ordered and you may join its waitlist instead. Joining the waitlist does not create a contract, a reservation or an obligation to purchase.

Re-Diagnostic eligibility. We check after payment that the track was previously evaluated through PETDUO 5R™. If it was not, we will inform you, cancel the order and refund the full price paid.

Tracks outside the service scope. PETDUO 5R™ is designed primarily for techno and closely related harder underground electronic styles. If, after receiving the submitted material and before beginning the diagnostic, we determine that the track clearly falls outside the scope of the service, we will inform you, cancel the order and refund the full price paid. No diagnostic work will be performed.

4. Onboarding & Track Submission

After payment you complete the onboarding form for your diagnostic and upload the track to be evaluated as one complete, playable WAV file directly in that form. One paid diagnostic covers one track. Additional uploads are not reviewed unless we request them.

If you uploaded the wrong file, please email 5r@petduo.com before we begin work.

If information is missing, or the uploaded file is incomplete, unplayable or not the track described in the onboarding form, we may suspend processing until the issue is resolved. Time spent waiting for missing information or a usable file does not count toward the delivery period.

Incomplete submission. If we have not received the completed onboarding form and a usable WAV file within 30 days of payment, we may set a reasonable additional deadline for submission. If that deadline expires without submission, we may cancel the contract and refund the full price paid. Please contact us at any time if you cannot submit your track in that period.

5. Prices & Payment

All prices are final prices in euros and include VAT. The total price and the VAT included are shown before payment, on the order confirmation page and again on the Stripe payment page. There are no additional charges.

Payment is due when you order and is processed by Stripe. Card payments are accepted; depending on your device and browser, Apple Pay or Google Pay may also be offered. After payment you receive a receipt by email, issued through Stripe on our behalf, showing the amount paid and the VAT included.

6. Delivery

The delivery period begins only when all three of the following are complete: payment has been confirmed, the onboarding form has been completed and a usable WAV file has been received.

The diagnostic is delivered by email to the address provided in the onboarding form. The video walkthrough of a Video Diagnostic is provided through a private viewing link. Please download and keep your delivered files within the availability periods stated in the Privacy Policy.

Business days are Monday to Friday, excluding public holidays in Berlin, Germany. We will contact you if a delay is anticipated.

7. Customer Obligations

By submitting a track for evaluation, you confirm and agree that:

• you own the submitted track or have obtained permission from all relevant artists, producers, writers and rights holders to submit it for private evaluation;
• you upload the track as one complete and playable WAV file in the onboarding form for your order;
• you provide complete and accurate information in the onboarding form;
• you do not submit unlawful material or content that infringes third-party rights;
• delays caused by incomplete information or a missing, incomplete or unusable file are your responsibility.

8. What Is Not Included

A PETDUO 5R™ diagnostic is a professional diagnostic and educational assessment. It does not include:

• editing, mixing or mastering of your track;
• a full mixing, mastering or technical audit (the Technical Snapshot of the Video Diagnostic covers one focused aspect only);
• a guarantee of release, label acceptance or commercial success;
• ongoing consulting or follow-up outside the delivered diagnostic;
• revisions of the delivered diagnostic (a revised version of your track can be evaluated through a Re-Diagnostic).

9. Intellectual Property

You retain all intellectual-property rights in the submitted track at all times.

For the limited purpose of providing the ordered service, you grant us a non-exclusive, non-transferable licence to access, download, temporarily store, internally reproduce and analyse the submitted track. Where a video walkthrough is included, this permission also covers the reproduction of limited excerpts of the track within your private diagnostic video. This permission does not allow public release, distribution, promotion or commercial exploitation of the track and ends when the applicable retention period described in the Privacy Policy expires.

We retain all rights in the PETDUO 5R™ methodology, framework, terminology, templates and report structure.

Upon delivery, you receive a personal, non-exclusive and non-transferable licence to use the delivered diagnostic. You may privately share it with artists, producers, engineers, managers, labels and collaborators directly involved with the evaluated track. The diagnostic may not be sold, commercially redistributed, publicly published, repackaged as another service or presented as your own methodology without our prior written permission.

Your track will not be publicly released, promoted or used for marketing purposes without your separate written permission.

Submission information, audio files, working materials and delivered diagnostic files are stored and deleted in accordance with the Privacy Policy.

10. Limitation of Liability

A PETDUO 5R™ diagnostic represents the professional judgment of PETDuo. It does not constitute a guarantee of release, label acceptance or commercial success.

Liability is unlimited in cases of intent or gross negligence; injury to life, body or health; mandatory statutory liability; and liability under applicable product-liability legislation.

In cases of slightly negligent breach of an essential contractual obligation (Kardinalpflicht), liability is limited to the foreseeable damage typical for this type of contract. Liability for slightly negligent breach of non-essential contractual obligations is excluded to the extent permitted by applicable law.

11. Right of Withdrawal & Early Performance

If you are a consumer, you have a statutory right to withdraw from the contract within 14 days. The full withdrawal information and the model withdrawal form are set out in our Withdrawal & Cancellation Policy. You can also withdraw online using our withdrawal function or by email to 5r@petduo.com.

To place an order, you expressly request on the order confirmation page that we begin the service before the end of the withdrawal period. This allows us to keep the stated delivery periods. We record this request with your order and confirm it in the contract confirmation. We begin work only after payment has been confirmed and the onboarding form and WAV file have been received.

As a consequence of this request:

• if you withdraw before we have begun work, you receive a full refund;
• if you withdraw after we have begun work but before the service has been fully performed, you may be required to pay a proportionate amount for the work already performed;
• once the service has been fully performed, your right of withdrawal expires.

12. Governing Law

These Terms are governed by the laws of Germany, excluding conflict-of-law provisions. If you are a consumer with your habitual residence in another country, you also retain the protection of the mandatory consumer-protection provisions of that country.

13. Dispute Resolution

We aim to resolve complaints directly. Please contact us at 5r@petduo.com. We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board, unless participation is required by applicable law.

14. Changes to These Terms

We may update these Terms for future orders. The version in force at the time of your order applies to that contract.
